It was presupposed that a dental surgeon protection in a lawsuit is a complete and elaborated dental record. The contract of service installment has always been characterized as one of the fundamental elements for the professional-patient relation, as well as way of patient protection. However, this contract is established in a tacit way or substituted by an authorization, which make the
professional venerable in what concerns to judicial proofs. The objective of this study is to divulge the importance of the informed consent term, that was consecrated in the scientific research area, which also present a great value for the Brazilian clinical practice. The term contains characteristics of contract, and a higher judicial value than the authorization, resulting in a new protection way for the Brazilian dental surgeon, and patient reciprocity in relation to his own treatment.
