Resumo
O objetivo deste artigo é considerar as teorias jurídicas e políticas e, de forma mais ampla, os conceitos teóricos sociais que podem, na prática, ser consistentes com os objetivos da crítica ao poder de Agamben. Como primeiro passo, relembraremos o significado da biopolítica e de conceitos fundamentais como comunidade, vida nua, forma-de-vida, estado de exceção e poder destituinte no projeto Homo Sacer de Agamben e no contexto de sua obra da Comunidade que Vem. Em seguida, em vez de procurar espaços de resistência, analisaremos a possibilidade de relações sociopolíticas e jurídicas que possam garantir justiça e equidade com base na dignidade humana, na autonomia, no reconhecimento mútuo e na solidariedade, em vez de dominação e governança biopolítica. Em relação ao direito, à política e ao poder, Agamben dá atenção especial às ideias de Schmitt e Benjamin, mas vale a pena romper com o sistema de pensamento baseado no soberano e no estado excepcional, permitindo o surgimento e a acentuação de diferentes pontos de vista, com a ajuda da justiça local, da democracia deliberativa, da justiça restaurativa, das percepções do ethos comunitário, da filosofia do ubuntu, da teoria social afetiva, em vez do individualismo neoliberal.
