Resumo

Este artigo explora a filosofia do direito de Agamben, destacando como sua visão sobre o tema se baseia em sua leitura da soberania e da biopolítica. Na verdade, no fértil debate sobre o biopoder de Foucault, Agamben fornece uma leitura original e radical da inclusão política da vida. A sua exegese incorpora a biopolítica numa teoria da essência da tradição ocidental e dos seus elementos fundamentais que são a lei e a soberania. No artigo, os desvios de uma “ortodoxia” foucaultiana remontam ao fascínio do filósofo italiano por Heidegger, Benjamin e Kafka. Portanto, Agamben desenvolve um método inédito e uma proposta política positiva. Por último, este artigo apresentará algumas deficiências do seu método, uma vez que uma abordagem ontologizante da política poderia obliterar, em vez de esclarecer, as múltiplas manifestações históricas do poder e tornar ineficazes as estratégias positivas contra a sua violência.
