O PROCESSO CONSTITUCIONAL NA JUSTIÇA DO TRABALHO: OS REMÉDIOS CONSTITUCIONAIS PARA O RESGUARDO DOS DIREITOS COLETIVOS E DIFUSOS EM MATÉRIA TRABALHISTA

Resumo

RESUMO: A pesquisa em questão versa sobre a possibilidade jurídica de alguns writs constitucionalmente previstos virem a atuar, de maneira válida, dentro do segmento especializado da Justiça do Trabalho com o condão de salvaguardar direitos eminentemente trabalhistas, estes decorrentes das mais diversas relações laborais (em especial àquelas de vetor supraindividual) dentro do território nacional, bem como investigar os desdobramentos jurídicos que decorrem da utilização sensata destes remédios em alçada processual trabalhista, assentado, basicamente, no artigo 114, IV, da Constituição Federal. O ensaio ainda pretende trazer a lume informações concisas que evidenciem a intenção do legislador constitucional de ter alargada a competência da Justiça do Trabalho, no ano de 2004, para que tal ramo do Poder Judiciário pudesse vir a apreciar questões de natureza originalmente constitucionais, por sua essência.

ABSTRACT: The research question concerns the possibility of some legal writs come to act constitutionally provided for,validly, within the specialized segment of the Labour Court with the power to safeguard labor rights eminently, these arising from different relations (especially those vector collective) within the national territory, as well as investigate the legal ramifications arising from the wise use of these remedies in heave procedural labor, sitting basically in article 114, IV, of the Constitution. The trial also aims to bring to light concise information showing the intention of the legislator to have extended the constitutional jurisdiction of the Labour Court, in 2004, for this branch of the judiciary could come to appreciate issues of constitutional originally, in essence.
