Abstract

The article seeks to present three criteria that could serve as indications for a test of the best theory of law, positivism or jusnaturalism. Considering that the crux of the matter is the relationship between law and morality, and that positivists generally defend the separation thesis, and that jusnatralists defend the connection thesis, the text scrutinizes the possible effects that the two conceptions have in relation to quietism, anarchy and the retroactivity of the law. It therefore deals with the relationship between legal positivism and jusnaturalism with wicked legal systems, especially Nazism. The text scrutinizes the Hart/Fuller debate in order to analyze the possible causal relatioships that would explain the connections between legal positivism and jusnaturalism with Nazism. It indicates that a similar debate could be reconstructed between Kelsen/Radbruch. The article argues that in terms of quietism, both theories are as if in a tie. For this reason, the search for possible effects was extended to other questions, such as the thesis of anarchy and complexity. In these last two areas, the article concludes that legal positivism has a slight advantage over jusnaturalism.
