Considerations about law, justice, force and obedience in the perspective of Jacques Derrida

Abstract

The present paper aims to trace the theoretical path taken by Jacques Derrida when analyzing the relationship between law, justice and force in order to demonstrate the unjustifiability of obedience to the law. Going back to the works of Kant, Pascal and Montaigne, we try to demonstrate the falsifiability of the presupposition that assumes the inseparable and necessary link between law and justice, pointing out that the condition of existence of law is, in fact, the resultant force of the mystical foundation that sustains law itself.
