Authorship and copyright of works created by generative artificial intelligence

The growing use of artificial intelligence (AI) in creative writing raises a fundamental legal and academic problem concerning the notions of authorship and copyright. The object of this study is the analysis of authorship of works generated with the aid of AI chatbots, such as ChatGPT. The objective is to discuss and propose a new interpretation of authorship, investigating to whom the rights to creative content belong: to the user, to the developing company, or to the creators of the training data. The methodology adopted is a bibliographic and documentary research, with a focus on the analysis of Brazilian Copyright Law (Law No. 9,610/98). The results demonstrate that the thesis most aligned with the current principles of the law is that of the user's authorship, by virtue of their intentionality, creativity, and curation, considering AI as a mere instrument. In conclusion, the paper points to the urgency of legal regulation in Brazil, highlighting the importance of collaboration among law, sociolinguistics, and computer science to ensure legal certainty and promote the development of ethical and socially responsible Ais.
