Abstract

This article addresses the regulation of Artificial Intelligence (AI) within the context of Cybernetics, highlighting the need for human oversight over complex systems. The central problem of this research lies in the significant fragmentation and diversity of institutional normative responses due to the innovative and disruptive nature of AI tools. The object of study consists of the different AI regulation models adopted in various countries. The objectives include analyzing these models and their implications for the Judiciaries of civil law countries that have regulated the use of these tools. The methodology employs Comparative Law, utilizing the functionalist method and a comparative analysis of international legislation and guidelines. The results indicate that, despite distinct approaches, there is a convergence toward guaranteeing fundamental rights and principles such as human supervision, transparency, and accountability. It is concluded that AI regulation adapts to the institutional context of each country, considering the rapid pace of technological evolution.
