Ocupações urbanas: as políticas públicas de acesso à terra no Brasil e o papel do Judiciário e do Executivo na efetivação do direito constitucional à moradia

Resumo

RESUMO: O objetivo do presente estudo é analisar a legitimidade das ocupações urbanas em propriedades que não estariam cumprindo sua função social, bem como o papel do Judiciário e da Administração Pública neste contexto. Embora o direito à moradia e a função social da propriedade sejam objeto de constantes discussões, o que se verifica frequentemente, é a omissão da Administração Pública na efetivação desse direito social. Sendo assim, após uma breve síntese do desenvolvimento do direito fundamental à propriedade e do direito social à moradia, será discutido o problema do acesso à terra no Brasil, e também a forma como os Poderes Executivo e o Judiciário devem agir, de maneira a efetivar o direito à moradia, para que este deixe de ser uma mera pretensão e se torne realidade.

Urban Occupations: The public politics of access to land in Brazil and the role of the judiciary and the executive in the realization of the constitutional right to housing.

ABSTRACT: The objective of this study is to analyze the legitimacy of urban occupations in properties that were not fulfilling their social function, as well as the paper of the judiciary and public administration in this context. Although the right to housing and social function of property are subject of constant discussion, which happens often, is the omission of Public Administration in the realization of this social right. Thus, after a short syntheses of the development of the fundamental right to property and social right to housing, will be discussed the problem of access to land in Brazil, and also how the Public Administration and Judiciary should act so as to effect the right to housing, so this must stop being a mere pretense and becomes a reality.
