A PROMOÇÃO DOS DIREITOS HUMANOS COMO PARÂMETRO DE LEGITIMIDADE DA INTERVENÇÃO DO ESTADO DEMOCRÁTICO NO DOMÍNIO ECONÔMICO

Resumo

RESUMO: As transformações político-ideológicas ocorridas nas sociedades ocidentais durante os dois últimos séculos foram determinantes para a atual definição do papel do Estado. O Estado Democrático de Direito é compelido, por um “dever historicamente construído”, a agir para promover o bem-estar coletivo. A correlação necessária entre este ideal de bem-estar e a promoção dos direitos humanos dá o parâmetro de legitimidade para a intervenção do Estado no domínio econômico.

Promotion of human rights as a benchmark of legitimacy for the democratic state intervention in the economic field

ABSTRACT: The political and ideological transformations that occurred in western societies during the last two centuries were decisive for the current definition of the role of the State. The Democratic State is compelled, by a "duty historically constructed," to act in order to promote the general welfare. The necessary correlation between this ideal of welfare and the promotion of human rights gives the measure of legitimacy for State intervention in the economic domain.
