A Busca pela Verdade no Tribunal Penal Internacional e o Diálogo entre os Sistemas Judiciais Adversarial e Inquisitório
Resumo
O presente artigo objetiva, inicialmente, analisar e comparar os sistemas judiciais adversarial e inquisitório, de modo a demonstrar a verdade buscada em cada um dos sistemas. Posteriormente, a partir da consideração de que o processo judicial internacional no Tribunal Penal Internacional não pode ser identificado exclusivamente a um dos dois sistemas judiciais em discussão, sendo, na verdade, formado por conjuntos de normas características do sistema inquisitório e do sistema adversarial, serão analisados alguns dispositivos do Estatuto de Roma, de modo a verificar como é definida a busca pela verdade na instituição.

The Search for Truth in the Internat ional Criminal Court and The Dialogue Between the Adversarial and the Inquisitorial Judicial Systems
Abstract: The present article aims, initially, to analyze and compare the adversarial and the inquisitorial judicial systems, in order to demonstrate the truth sought in each system. In a second moment, considering that the international judicial procedure in the International Criminal Court cannot be exclusively identified to one of the two systems discussed, in a manner that it is constituted by groups of adversarial norms and of inquisitorial norms, some provisions of the Rome Statute will be analyzed, and it will be verified the manner how the search for truth is defined in the institution.
