The imputability of the psychopath in front of the art. 26 of the Penal Code

Psychopathy is a personality disorder object of constant research in various fields, especially in Psychiatry and Psychology. On Criminal Law, the psychopath represents a field of debates regarding your legal framework as unimputable, semi-imputable or imputable. In that sense, this paper aims to answer the question if a psychopath is or not an imputable, therefore culpable, individual, sustaining the thesis on the psychopath’s imputability. The research was made through the deductive method and bibliographic review, along with books and articles related to imputability and psychopathy, as well as its treatment possibilities. The article is divided in three sections, aimed to analyze, respectively, unimputability, semi-imputability and imputability of a psychopath. The results demonstrate a psychopath is completely capable of understanding the illicitness of the criminal fact and determinate your actions accordingly to this understanding, being an imputable and culpable individual, confirming the thesis sustained.
