In this article, we will introduce a critical-reflexive analysis of the way in which Comparative Constitutional Law has been used within the contemporary theoretical debate. To this end, we reconstruct the path taken by the concept of Constitution in Modernity, coming to understand the fundamental assumption of global expansion of the constitutionalist presents and, consequently, how this helped in the rise of the comparative approach in contemporary times. Finally, some questions are raised related to the inappropriate use of Comparative Constitutional Law in addition to critical notes about the very category of “methodologically loose constitutionalism”, used by Emílio Meyer.
