"A QUESTÃO PENITENCIÁRIA", DE AUGUSTO THOMPSON

Abstract

RESUMO: Este trabalho tem como objetivo analisar a obra “A QUESTÃO PENITENCIÁRIA”, de Augusto Thompson, que destaca a crise do sistema penitenciário brasileiro, enfatizando sua incapacidade em promover a recuperação dos criminosos. Tal análise será feita em confronto com a posição defendida por demais autores consagrados da literatura jurídica penal nacional e estrangeira no que se refere às funções do direito penal, as finalidades da pena e na capacidade da pena de prisão em promover tais finalidades.

ABSTRACT: This paper aims to analyze the book “A QUESTÃO PENITENCIÁRIA” by Augusto Thompson, highlighting the Brazilian penitentiary system, emphasizing its failure to promote the recovery of criminals. Such analysis will be made in comparison with the position advocated by other established authors from brazilian and foreign criminal law literature, regarding the functions of criminal law, the purposes of the penalty and the ability of imprisonment in promoting these goals.
