DA POSSIBILIDADE DO RECONHECIMENTO DE UNIÃO ESTÁVEL EM FACE DO ENFERMO MENTAL DECLARADO ABSOLUTAMENTE INCAPAZ PARA OS ATOS DA VIDA CIVIL

Abstract

RESUMO: O presente estudo visa discutir um tema tratado com pouca profundidade, tanto pela doutrina quanto pela jurisprudência, embora de vital importância para um determinado grupo de pessoas. O judiciário tem se mostrado resistente a admitir a possibilidade de um enfermo mental conviver em união estável com outra pessoa, ao fundamento de que existiria expressa vedação legal para o reconhecimento desta situação jurídica, no art. 1548, I, do Código Civil de 2002. Contudo, além de haver uma interpretação equivocada do dispositivo, que permite de forma expressa o casamento, e logo, o reconhecimento de união estável, do enfermo mental com o necessário discernimento para prática deste ato, há uma grave violação aos direito humanos, em especial, a dignidade do enfermo mental, uma vez que a busca pela vida a dois e pela constituição de uma família são inerentes à natureza humana, seja a pessoa portadora de moléstia mental ou não.

ABSTRACT: The present study aims to discuss a theme treated with little depth, by both the doctrine and by the case law, although vitally important to a certain group of people. The judiciary has been shown to resistant to admitting the possibility of a mentally ill live in a stable union with another person, to de bases of that there would be express legal prohibition to recognize this legal situation, in art. 1548, I, the Civil Code of 2002. However, besides there is a misinterpretation of the device that explicitly permits the marriage, and soon, the recognition of the stable union, the mentally ill with the necessary insight to practice this act, there is a grave violation of human rights, in particular the dignity of the mentally ill, since the search for life together and establishing of a family, are inherent in human nature, independently of the presence or absence of a mental disease.
