A NOÇÃO DE RENASCIMENTO: CONTRIBUIÇÃO PARA UMA HISTÓRIA DO ESPAÇO JURÍDICO

Abstract

RESUMO: Este artigo visa a situar a noção de “Renascimento” na historiografia do direito e na historiografia geral. Pretende-se identificar a origem do termo “Renascimento”, sua relevância no século XV-XVI e durante o Romantismo, nas figuras de Vasari, Michelet e Burckhardt. Sugerindo a importância da Renascença para a formação de um espaço jurídico determinado, vai-se cotejar o movimento de “renascimento jurídico” e “fenômeno jurídico no Renascimento”.

ABSTRACT: This article aims to situate the notion of Renaissance in Law and general historiography. The intention is to identify the origin of the term “Renaissance”, its relevance in the XV-XVI century and during Romanticism in Vasari, Michelet and Burckhardt. Suggesting the importance of the Renaissance to the formation of a particular juridical space, the movement of legal rebirth and the legal phenomenon in the Renaissance will be compared.
