ASSISTENTE DE ACUSAÇÃO: A PARTICIPAÇÃO DA VÍTIMA NA AÇÃO PENAL DE INICIATIVA PÚBLICA

Abstract

RESUMO: O presente trabalho tem como objetivo analisar a participação da vítima na persecução penal ao longo da história, culminando com a função de assistente de acusação exercida na ação penal de iniciativa pública. Investiga-se, também, a legitimidade para atuar como assistente e o interesse que move a vítima a requerer sua habilitação, bem como a possibilidade de interposição de recurso contra sentença penal condenatória e a constitucionalidade do instituto.

ABSTRACT: This study aims to analyze the victim participation in criminal prosecution throughout history, culminating in the role of prosecution assistant in the unconditioned public criminal prosecution. It also investigates the legitimacy to act as assistant and the interest that moves the victim to request his habilitation as well as the possibility of an appeal against criminal sentence and the constitutionality of the institute.
