ABOLITIO CRIMINIS DO DESACATO: UM OLHAR SOBRE A RELAÇÃO ENTRE AUTORIDADE PUBLICA E O PARTICULAR NA AMÉRICA LATINA

Abstract

O presente artigo tem como foco a análise da derrogação do tipo penal do desacato nos países latino-americanos. Para tal feito, buscou-se, inicialmente, elementos na história do direito que pudessem evidenciar que têm sido a tônica do Direito uma relação mais isonômica entre Estado e o particular. No contexto, demonstra-se a tendência dos países latino-americanos para abolirem o desacato, seja através de posicionamentos de organizações internacionais ou através de incidentes ocorridos nos países. Nesse esforço, é fruto de análise as peculiaridades do caso brasileiro. Porém, mesmo que com traços que lhe são próprios, no Brasil encontramos sinais de que o país, assim como os demais de origem ibérica, está em vistas de descriminalizar a ofensa contra o funcionário público.

ABOLITIO CRIMINIS OF CONTEMPT: A LOOK AT THE RELATIONSHIP BETWEEN PUBLIC AND PRIVATE AUTHORITY IN LATIN AMERICA

ABSTRACT

This article focuses on the analysis of the detract of criminal contempt in Latin America countries. Purpose, we originally sought some elements in the history of law,  showing that the search for a more parity relationship between the State and the citizen has been the keynote of the law. In this context, verified the trend of Latin American countries to abolish the contempt, either through the international organizations position or through incidents that happened in the countries. In this endeavor, it is the result of the analysis of the peculiarities of the Brazilian case. However, even with its own features, in Brazil we find signs that the country, as well as the rest of the other Iberian countries, seems to soon decriminalize the offense against the public employees workers.
