perspectives on the (in)sufficiency of brazilian regulation

Abstract

The present work investigates the limits of the creative action of artificial intelligence (AI) and its commercial implications, focusing on the need to rethink the concept of authorship and copyright. The research analyzes diverse sources that address AI from different perspectives, from its history to its applications in the phonographic industry, considering opportunities and challenges. It starts from the premise that AI, although a human creation, demonstrates a growing capacity to generate works previously seen as exclusive to the human mind. This disruptive potential raises complex questions about the limits of machine creativity and the economic impact. A central point is the need to re-evaluate the concept of authorship in the face of AI's participation in the creative process, exploring proposals for the protection of works produced with its collaboration. The work is anchored in the perspective that technology is a constitutive part of human culture and the human being is, essentially, a technological being. In this sense, it seeks to offer a critical and reflective analysis of the challenges and opportunities that AI represents for the future of art and culture. The methodology used is qualitative and quantitative, with analysis of content and concepts, in addition to the examination of examples of artistic works developed with the aid of AI, illustrating different approaches to this new form of creation.
