Dano moral ambiental objetivo: uma discussão necessária

Resumo

Resumo: O dano moral ambiental objetivo, tema novo e ainda não sedimentado na jurisprudência e doutrina pátrias, necessita de uma argumentação a seu favor que vá além daquela estritamente jurídica. Considerando a complexidade que envolve a efetiva tutela do meio ambiente no âmbito proposto, nas esferas preventiva e repressiva, necessária se faz a abordagem da relação direito\sociedade. Sobre a hermenêutica jurídica ambiental, impõe-se, igualmente, como cerne do objeto de estudo, uma perspectiva jurídica, que consiste em apontar argumentos para reforçar a responsabilização do agente do dano moral ambiental na perspectiva objetiva.

Objective Environmental Damage: A necessary discussion

Abstract: Objective environmental damage is a new issue and still not yet well discussed inbrazilian jurisprudence. It is in need of an stronger argumention to favour it, that is to say, the kind of argumentation that goes beyond the strictly legal one, although including this kind ofarguments. Vis-à-vis the complexity of environmental defense in both preventive andrepressive aspects, it is necessary to approach the link between Law and society. Also the new proposal of an specific environmental legal interpretation imposes itself,in order to easy the comprehension of the core of our investigation, specially from a legalpoint of view, so that we reinforce the responsabilization of those that cause damage to theenvironment, treating it as a kind of objective responsability.
