The search for truth in labor processes in pandemic times
Abstract
Labor law uses mechanisms such as in dubio pro operario in situations of factual uncertainty as one of its ways of protecting the worker, who is in general vulnerable vis-à-vis the employer. Furthermore, the labor procedural environment also does not give up seeking, primarily, for the truth, and may even give victory to the employer. However, in times of pandemic and consequent crisis, with an increase in labor demand, one of the difficulties faced is that of overcoming obstacles to the search for truth and making the protection of workers compatible without giving up an epistemologically valid decision, which is condition of justice.
