Política nacional de resíduos sólidos: o viés democrático, cooperativo e social

Abstract

Resumo: O presente artigo expõe uma avaliação da Lei n°12.305/2010, que dispõe sobre a Política Nacional de Resíduos Sólidos, a partir do enfoque jurídico-filosófico, na medida em que analisa o viés democrático, cooperativo e social que a legislação em questão demanda. Após um breve histórico e um questionamento acerca da definição de cidadania para o Direito, o trabalho aborda a educação ambiental como o mais importante instrumento para a eficácia da lei, pois a atitude deve provir do indivíduo, e não mais como uma tutela estatal permanente. Conclui-se que a logística reversa é o melhor sistema atualmente, mas que outras medidas poderiam ser incentivadas para a correta disposição dos resíduos sólidos.

National Act for Solid Waste: democratic, cooperative and social perspectives

Abstract: The present work aims to evaluate the Law 12.305/2010, which provides for the National Act for Solid Waste, from the legal-philosophical approach, as it examines thedemocratic, cooperative and social perspectives in the matter. After a brief history and a survey about the definition of citizenship according to the law, the work concludes that environmental education is the most important tool for effectiveness in Law, as the initial step must come from the individual, and not as a permanent state custody. It also concludes that reverse logistics is nowadays the best system for the proper disposal of solid waste, but that other measures could be encouraged.
