O manifesto de mina e a compensação financeira pela exploração dos recursos minerais

Abstract

RESUMO: O manifesto de mina constitui figura jurídica de exceção dentro do Direito Minerário, recebendo dispositivos específicos dentro da legislação. Ele surgiu como uma forma de garantir direitos provenientes de um ordenamento anterior ao vigente. Para tanto, as constituições que se seguiram, a partir da de 1934, e a própria legislação minerária, cuidaram de proteger tal instituto. A Compensação Financeira pela Exploração dos Recursos Minerais– CFEM, desde o momento em que foi instituída e regulamentada, foi alvo de polêmicas acerca da sua natureza jurídica e de sua aplicabilidade. Isso porque, apesar de apresentar características inerentes ao regime tributário, não pode ser considerada como um tributo. O principal objetivo será através da busca da natureza jurídica desse instituto,comprovar se o manifesto de mina seria passível de ter, sobre a sua exploração, a incidência da CFEM, já que o mesmo constitui uma exceção dentre os regimes de exploração previstos no ordenamento jurídico.

The Mine Manifest and the Financial Compensation for the Exploitation of Mineral Resources

Abstract: The mine manifest constitutes legal figure within the mining law exception, receiving specific devices within the legislation. It emerged as a way of securing rights from a previous order to force. For both, the constitutions that followed, from 1934, and mining legislation, took care to protect such Institute. The Financial Compensation for Exploitation of Mineral Resources-CFEM, from the moment in which it was established and regulated, was the target of controversy about their legal nature and its applicability. This is because, although presenting characteristics inherent in the tax regime, cannot be considered as a tax. The main objective will be to search through the legal nature of that Institute, check if the mine manifest would be liable to have, on their exploitation, the incidence of CFEM, since the same is an exception among the explorationregimes specified in the legal system.
