O trabalho penitenciário e a ressocialização do preso no Brasil

Abstract

RESUMO: O objetivo do presente artigo é analisar os aspectos jurídicos centrais do trabalho penitenciário no Brasil, partindo-se da concepção de que a função do trabalho, enquanto direito e dever do preso, é a de ressocializá-lo. O estudo indica que o presidiário não é tratado de maneira isonômica em relação ao trabalhador livre e que os presídios geralmente não apresentam condições materiais e humanas adequadas para a realização desse trabalho, ficando prejudicada a recuperação do preso. Apesar de a maioria dos condenados à pena privativa de liberdade cumpri-la no sistema carcerário comum, várias foram as iniciativas nas últimas décadas para promover a humanização das prisões e evitar a reincidência no crime, como a criação de Associações de Proteção e Assistência aos Condenados, que propiciam ao preso, além da realização de trabalho condizente com seu regime de cumprimento de pena, assistência espiritual, médica, psicológica e jurídica.

ABSTRACT: The aim of the present article is to analyze the main legal aspects of penitentiary work in Brazil, basing on the notion that the objective of working in imprisonment facilities, as a legal right and duty of the convict, is to resocialize prisoners. The study indicates that convicts are not treated in an equal manner when compared to free workers, and that prisons in general do not present adequate material and basic human conditions for doing this type of work, which hinders prisoners’ possibilities of recovery. Despite the fact that the majority of convicts in confinement are serving their sentences in ordinary penitentiaries, there have been several initiatives within the last decades in order to promote better conditions for prisons and avoid crime relapse. One of such initiatives is the creation of the Association for the Protection and Assistance to the Condemned, that allows convicts to engage in working activities that are compatible with the serving regime of their sentences, offering as well spiritual guidance, medical, psychological and legal assistance.
