Entre lei humana e lei divina: Filosofia do Direito no pensamento do nomos a partir de um fragmento de Heráclito de Éfeso

Abstract

RESUMO: O trabalho procura interpretar o fragmento nº 114 (Diels-Kranz) do filósofo pré-socrático Heráclito de Éfeso e compreendê-lo a partir da filosofia do direito. O fragmento revela-se problemático em dois pontos: i) o significado da palavra nomos (aqui traduzida como lei); ii) a relação entre lei humana e lei divina. Do esforço em compreender o fragmento depreendem-se caminhos essenciais tomados pela filosofia do direito. Esses caminhos partem dos binômios transcendência/imanência e necessidade/possibilidade, que surgem na interpretação do fragmento ao se pensar as origens do significado de lei

ABSTRACT: The work aims to interpret the fragment nº 114 (Diels-Kranz) of the Presocratic philosopher Heraclitus of Ephesus and to understand it in the light of the legal philosophy. The fragment reveals itself problematic in two points: i) the meaning of the word nomos (here translated as law); ii) the relationship between human law and divine law. From the efforts in understanding the fragment one could recognize essential paths taken by the legal philosophy, such as the binomials transcendence/immanence and necessity/possibility
