Abstract

This article aims to present the theory of trust as the foundation for contractual obligation, exploring its role in justifying contractual relationships. The methodology employed is based on the analysis of doctrines available in books and online articles, both domestic and foreign, which address the theory of trust in the context of contract law. The theory of trust goes beyond mere expression of the parties' will or the outcomes intended or expected to be achieved when the contract was entered into, emphasizing the legitimacy of the expectations vested in the contractual relationship. The results demonstrate that it not only provides an answer to the nature of the bond established in obligatory relationships but also establishes a solid and morally defensible foundation for contract law.
