Resumo: As operações de paz da Organização das Nações Unidas (ONU) são uma de suas principais formas de ação para oferecer assistência humanitária e [re]estabelecer a paz em locais assolados por catástrofes naturais, conflitos políticos, guerras civis e violações de Direitos Humanos. Esse valoroso trabalho, entretanto, é maculado pela conduta de alguns agentes de paz que se aproveitam da condição de fragilidade da população local para explorar e abusar sexualmente de mulheres e crianças. Os agentes de paz são militares fornecidos pelos Estados Membros da ONU para conduzir os trabalhos na localidade que receberá a operação de paz. Uma vez que esses militares encontram-se submetidos à jurisdição exclusiva de seus Estados de origem, é de responsabilidade desses Estados a atuação com a devida diligência, isto é, o cumprimento dos deveres de investigar e punir os crimes de exploração sexual, garantindo o acesso das vítimas à justiça e à devida reparação.

STATE RESPONSIBILITY FOR SEXUAL CRIMES COMMITTED BY U.N. PEACEKEEPERS
Abstracts: The peacekeeping operations of the United Nations (U.N.) are one of its main forms of action in order to provide humanitarian assistance and to [re]establish peace in places stricken by natural disasters, political conflicts, civil wars and human rights violations. This valuable work, however, is jeopardized by the conduct of some peacekeepers who take advantage of the weakness oflocal population to exploit and sexual abuse women and children. The peacekeepers are militaries provided by U.N. Member States to work in the area which will receive a peacekeeping operation. Once these soldiers are subjected to the exclusive jurisdiction of their States of origin, it is the responsibility of those States to act with due diligence, that is, to comply with the obligations to investigate and punish sexual crimes, ensuring the access to justice and the proper reparation for victims.
