Artigo 293 da UNCLOS como cláusula jurisdicional?

Resumo

O artigo 293 da Convenção das Nações Unidas sobre o Direito do Mar (UNCLOS ou Convenção) trata do direito aplicável às cortes e tribunais previstos na Convenção.  No entanto, os limites da interpretação deste dispositivo se demonstram, ainda, controversos quanto ao seu uso como cláusula jurisdicional. Apesar das regras de jurisdição especificadas no artigo 288 da UNCLOS, cortes e tribunais têm decidido diversamente sobre esta utilização do art. 293 da Convenção, ora admitindo a demanda, ora rejeitando-a. Nesse ínterim, este artigo propõe investigar qual a interpretação mais adequada para conferir estabilidade ao mecanismo de solução de controvérsias estabelecido pela Convenção.
