Abstract

Placed between constituent and constituted power, homo sacer reveals the state of exception, which through sovereign ban, is kept both inside and outside the law. Agamben’s latest political and legal philosophy is based upon this concept. As the victim of sovereignty, homo sacer unfolds the paradox of sovereign power, criticizing its fundamentals and showing the emptiness of law. However, for potentiality which is at the centre of Agamben’s argument, we need to look not only outside sovereignty and sovereign power, but also outside homo sacer. This article aims to examine such space, arguing that through absolute potentiality, the fulfilment of law is possible with the content to be focused on reaching conditions of justice and happy life.

Vanja Grujic, Federal University of Pernambuco

Vanja Grujic é professora visitante no Programa de Pós-Graduação em Direitos Humanos da Universidade Federal de Pernambuco. Concluiu seu doutorado e pós-doutorado na Faculdade de Direito da Universidade de Brasília. Parte de seus estudos de doutorado foi realizada no Centro de Direito e Política Europeia (ZERP), na Universidade de Bremen. Atuou como pesquisadora visitante na Faculdade de Direito da Universidade Autônoma de Madri e no Instituto para Filosofia e Pesquisa Social (IFDT) em Belgrado. É também mestre pela Faculdade de Ciências Políticas da Universidade de Belgrado. Sua tese de doutorado foi publicada com o título Balkan Pathologies of Modernity: The National Question Between Conflict and Consensus (2018) pela Nomos Verlag. Seu interesse de pesquisa atual concentra-se na teoria política e jurídica, com ênfase nas inter-relações entre violência, políticas públicas e direitos humanos, a partir da perspectiva da teoria crítica do direito.
