Humanized education versus merchandise in private legal education in Brazil

The purpose of this thesis is to address the following problem: “humanized education versus merchandise in private legal education in Brazil”. The hypothesis raised in response to the thesis problem, which was ultimately confirmed, is that the educator is one of the factors that can minimize the effects of mass education and humanize this relationship between the student and the institution, being a fundamental element for fulfill the social function of private colleges. In order to reach the proposed objective, it is necessary to make historical considerations of legal education in Brazil and its influences on academic merchandise, for the trivialization of legal education and the commercial dominance of private colleges. A market analysis essay will be carried out based on the data available on public platforms such as INEP (National Institute of Studies and Educational Research Anísio Teixeira), considering the period from 1996 to 2016. From this analysis, graphs are extracted to represent the growth of the academic market and to explore the socioeconomic factors that influenced this demand. It is also proposed as a specific objective to analyze the importance of technology as a new language and its consequences in the massification and quality of legal education. As a theoretical framework it is established that the democratization of higher legal education aims to make it accessible to all. However, as a result, it is clear that this requires an intellectual investment on the part of the State, society and family, in the educator, in the student and in the awareness of private universities to promote the balance between profit motives and the fulfillment of the social function, as well as a restructuring in academic curricula that would move away from dogma and bring closer to humanization, seeking to reduce the reflexes that are inherent to any and all perverse human massification. Regarding the methodological bias, the use of the historical aspect, the deductive, hypothetical-deductive and dialectical method are emphasized. In the procedural field, bibliographical and doctrinal research, legislative, documentary and field research were used. As for the approach, the qualitative technique was used.
