Estado-Nação, legislação e políticas de migração no Brasil
a questão da cidadania em tempos de alteridade
Abstract
This article intends to bring reflections on the role of the Brazilian nation-state in the drafting of specific laws aimed especially at migrant populations. To this end, it is important to consider the issues that involve the construction of national identity, the role of the nation as well as its legislative, bureaucratic and regulatory apparatus, typified in the figure of a State, as one of the essential and defining factors in the elaboration of public policies for immigrants and refugees: The text was prepared based on theoretical reflections by authors who address the existing conflicts between the nation-state, ethnicity and population movements in Europe; in historical analyzes of the Brazilian national identity construction processes and the encouragement of immigration policies to Brazil; and finally, the examination of two national laws and one municipal law relating to immigrant and refugee populations: Law n. 6,815 of 1980; Bill no. 2,516 from 2015; and, finally, Municipal Law 16,478 of 2016 of the city of São Paulo, which establishes a Municipal Policy for the Immigrant Population.
