o culturalismo de Miguel Reale em sua teoria tridimensional do Direito. Um processo fenomenológico

Abstract

Miguel Reale became known in Brazil and around the word due to his tridimensional theory of lay. Escaping interpretations of formal logic, with its validity precepts, Reale rejects interpretations that did not considerer the law based on the deep social structure. His theory is actually a sociological, historical, philosophical analysis, bringing culture in the broadest sense of the term as a fundamental elemento of legal Science. Right for Reale is the implication of the elements, which, depending on the evolutionary stage of each culture, the inevitability of the spirit, and especially human needs, end up explaining the existence of man in the word. In his connections of meaning, Reale retrieves  authors from the most diverse áreas, such as Husserl, Dilthey, Kuhn, Levi-strauss, and, more specifically in his área, figures suc as Lask and Radbruch. In this sense, Reale would introduce in the field of law a culturalist conception, tributary of Tobias Barreto, disregarding the legal positivism characterized by normativism, replacing it with a look turned to values, to the daily needs of the people
