Abstract

The text is divided into twelve sections and is based on a theoretical gap in the Brazilian academic arena. There are few debates and studies dedicated to understanding how value-based disputes arise, and few in-depth research investigating the best ways to handle these kinds of disputes. This is the focus of the article, which is based on a bibliographic effort guided by the legal-comprehensive investigation procedure and presents an overview about Alternative Dispute Resolution, especially negotiation and mediation. In order to make possible the understanding of a specific type of conflict - values and identity-based disputes, some elementary concepts about conflict are presented. The article shows that a whole series of conflicts remain apart from Justice and, to contribute to overcoming such a lapse, proposes that our science appropriates knowledge from the theory of negotiation and mediation so that schools can disseminate such knowledge. In this way, disputes such as those arising from political polarization, typical conflicts of value, may receive more adequate treatment and there may be more tranquility for people and the certainty that the Brazilian scientists are concerned, acts and address many types of conflicts between people.
